The indicative price quoted for the novated lease is based on vehicle quotations Maxxia has received within the last 45 days and does not include any optional extras. Any optional extras that you choose will affect the cost of the novated lease and residual value. If you purchase the vehicle on termination of the novated lease, GST will apply on the purchase price you pay at that time. The novated lease offer is based on the assumption outlined above, and is an indicative cost approximation of the selected vehicle and model shown and the amounts may change at the time the novated lease quotation is completed and finalised. Your individual circumstances have not been taken into account as this will affect the overall weekly cost amount and the benefits of a novated lease. These specials cannot be used in conjunction with any other offer. From 1 April 2025, a plug-in hybrid electric vehicle will not be considered a zero or low emissions vehicle under the FBT legislation law. However, you can continue to apply the exemption if both the following requirements are met: 1) Use of the plug-in hybrid electric vehicle was exempt before 1 April 2025. 2) You have a financially binding commitment to continue providing private use of the vehicle on and after 1 April 2025. For this purpose, any optional extension of the agreement is not considered binding.
+Information on how to enter and details about the BYD cashback promotion (“Promotion”) form part of these terms and conditions. By entering into the Promotion, you agree to and accept the following terms and condition:
1) The Promotion is conducted by Maxxia Pty Ltd (ABN 39 082 449 036) ("Promoter").
2) The eligibility criteria for this Promotion are as follows (“Eligibility Criteria”):
a) The Promotion is open to individuals who are aged 18 years and over and who are employed by employers in the Health, Education and Emergency Services industries ("Eligible Employee");
b) The Promotion is valid from 3rd September 2024 Australian Eastern Daylight Time (“AEDT”) to 31st October 2024 AEDT ("Promotion Period")
c) The Eligible Employee must enter into a novated lease, through the Promoter, for a new BYD vehicle during the Promotion Period. For the purpose of this Promotion, a new BYD vehicle means a BYD car which is first ordered between 3rd September and 31st October 2024 and delivered by 31st December 2024.
3) Provided that the Eligibility Criteria is met and these terms and conditions are complied with, the Eligible Employee will receive a cashback of $1,000 (“Cashback”) upon the settlement of the novated lease with the relevant financier of the lease and the delivery of the Vehicle. The Eligible Employee acknowledges that the Cashback will be paid to them directly by EVDealer Group Pty Ltd trading as BYD Automotive (“BYD Automotive”) by way of Electronic Funds Transfer (“EFT”) to the Eligible Employee’s designated bank account.
4) For the purpose of this Promotion and the payment of the Cashback, the Eligible Employee agrees to:
a) Maxxia providing to BYD Automotive the Eligible Employee’s information (including their name, phone number and email address);
b) BYD Automotive contacting the Eligible Employee directly to obtain any and all requisite information for the purpose of this Promotion, including to obtain the Eligible Employee’s designated bank account details; and
c) Provide up-to-date and accurate information to Maxxia and BYD Automotive, including their designated bank account details.
5) The Eligible Employee agrees that Maxxia and BYD Automotive are not responsible for any Cashback which is lost in transmission or any incorrect EFT payment resulting from the provision of inaccurate details. The Eligible Employee further agrees that Maxxia is not liable in the event that there is any dispute regarding the payment of the Cashback, including any non-payment of such.
6) The Eligible Employee can only enter into this Promotion once and will only be entitled to claim the Cashback once. The Promotion cannot be combined with any other offer or promotion.
7) The Eligible Employee acknowledges that they are solely responsible for the choice of Vehicle and have relied on their own investigations when selecting the Vehicle. The Promoter makes no representation as to the suitability of any Vehicle.
General
1) The Cashback is not transferable, exchangeable and is not redeemable for cash.
2) The Promoter excludes all warranties in relation to supply of the Cashback, except those that cannot be excluded by law.
3) The Promoter reserves the right to alter or amend these terms and conditions, and to suspend cancel or terminate the Promotion and these terms and conditions without notice at any time throughout the Promotion Period. If you have met the Eligibility Criteria prior to such alteration or amendment of these terms and conditions, or the suspension, cancellation or termination of the Promotion and these terms and condition, then such will not be applicable to you and the version of the terms of conditions at the time you met the Eligibility Criteria will apply.
4) If, for any reason, the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to take any action that may be available.
5) The Promoter reserves the right to refuse or reject any entry into this Promotion and to deem any Eligible Employee ineligible for the Cashback if the Promoter determines or is of the reasonable opinion that the Eligible Employee does not meet or comply with these terms and conditions, or has tampered or interfered with the entry mechanism in any way.
6) The Promoter will use and handle all personal information in accordance with its Privacy Policy, which can be viewed at www.maxxia.com.au/privacy-policy. The Privacy Policy sets out how an individual may access, update or correct their personal information, change their direct marketing preferences. 7) To the extent that these terms are unenforceable or do not comply with the law, that term is to be read down, or excluded to the extent required to comply with the law.
8) The Eligible Employee agrees that: (a) they may be contacted by the Promoter to provide comments about the Promotion; the Promoter (or an agent of the Promoter) may take and/or use photos of them; and (b) the Promoter may use comments or photos referred to in clause 8)(a) and/or clause 8)(b) (as relevant) (the "Materials") for the Promoter's future promotional and marketing purposes without further reference or compensation to the Eligible Employee. If the Eligible Employee does not wish to be contacted to provide comments and/or for photos of them to be taken or used, they may notify Maxxia by emailing [email protected] or by letting Maxxia know when Maxxia contacts them for such comments and/or photos.
9) The Eligible Employee further agrees and acknowledges that: (a) the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at anytime, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same; and (b) the Promoter shall own the intellectual property rights (including but not limited to, copyright and moral rights) in the Materials as and from creation of such.
10) To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever (including but not limited to direct or indirect loss and consequential losses) or personal injury suffered or sustained in connection with this Promotion.
11) The Promoter is not responsible for any tax and financial liabilities that may arise from claiming the Cashback or otherwise in connection with the Promotion and from entering into a novated lease. The Promoter recommends that independent taxation, financial and legal advice be obtained by the Eligible Employee prior to making any financial decision or entering into this Promotion.
